How to Protect yourself from Insurance Company Doctors

In almost any serious injury case, especially brain damage cases, the insurance company will arrange for their doctors to examine the injured person. The insurance industry calls them Independent Medical Exams (IME) but this is misleading as these paid insurance doctors are hardly independent and often make a great deal of money from insurance companies to testify that injured people are not really hurt or that their problems are related to anything but the accident.

We always fight vigorously to videotape the examinations. The reason for doing this is that insurance doctors will issue reports that are not always accurate when one reviews the videotape. In a trial, an insurance doctor left omitted testing that he gave the showed a very serious speech impediment. He also misreported the results of a memory tests.

In another case recently, the insurance doctor falsely wrote that our client was able to remember 3 words several minutes after being asked to remember them when in fact the videotape showed it was 31 seconds. This same doctor wrote in her report that our client was able to subtract 7 from a hundred successfully but failed to mention that she helped her to do the task. if not for the videotapes, these insurance doctors would get away with falsifying or misreporting results.
